Hmm... What is the long and the short of meeting the requirement if builders like myself have already rounded up the plastic tanks, the fills and the vents...?

Just got a phone call from my O.B. mechanic regarding my boat being ready, talked to him a little bit about these mew regs. They have been told that 2011 and newer models they have FOR SALE will need to meet the requirements. Older models people already own are grandfathered, with a strong recommendation for people with grandfathered systems to make them compliant. He wasn't sure how this would affect the homebuilts, other than thinking that if it had not been completed and registered prior to the new regs they would "probably" need to be compliant. Again, he said he wasn't for sure regarding homebuilts.

Casey, are you sure you new tank isn't already compliant?? I had a couple of older tanks given to me and as I read it I can't use them. I have been looking around for an under the sole tank on the web and all seem to be up to the new regs. When did you buy it? Maybe send it back for an exchange if necessary?

Well I purchased them from a marine surplus. They were discountinued so I assume they are not up to snuff. I was looking through the parts offered from Perko and it looks like I can retro one to make it work.

It's all pretty confusing to me. My Moeller tank is long sealed under the cabin sole, so it could be an awful pita. I can argue it was built before the reg changes but who knows :doh:

I was speaking with a friend and this may be an option. Power with a 2011 motor and complete the build by 12/31/2012 and we may be ok.

Check out paragraph (f).
(f) Evaporative emission standards generally apply based on the model year of the equipment, which is determined by the equipment's date of final assembly. However, in the first year of new emission standards, equipment manufacturers may apply evaporative emission standards based on the model year of the engine as shown on the engine's emission control information label. For example, for fuel tank permeation standards starting in 2012, equipment manufacturers may order a batch of 2011 model year engines for installation in 2012 model year equipment, subject to the anti-stockpiling provisions of 40 CFR 1068.105(a). The equipment with the 2011 model year engines would not need to meet fuel tank permeation standards as long as the equipment is fully assembled by December 31, 2012.
